1. Purpose
1.1. This cookie policy (hereinafter the "Cookie Policy") describes how NOOBA SRL (hereinafter "NOOBA", "we", "us" or "our") uses cookies and similar technologies on the website accessible at www.nooba.be (hereinafter the "Site").
1.2. The Cookie Policy supplements NOOBA's privacy policy, to which it refers for all other matters, and applies without prejudice to it.
1.3. NOOBA places and reads cookies on the Site in accordance with Regulation (EU) 2016/679 (hereinafter the "GDPR"), the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data, the Act of 13 June 2005 on electronic communications and, in particular, Article 129 thereof, as well as Guidelines 05/2020 of the European Data Protection Board and the recommendations of the Belgian Data Protection Authority concerning cookies, including the so-called "Planet49" decision and the recommendations relating to cookie banners.
2. What is a cookie?
2.1. A cookie is a small text file that a website stores on the user's terminal (computer, tablet or phone) when that site is consulted, and which may be read again during later visits. For the purposes of this Policy, all similar technologies (tracking pixels, web beacons, browser local storage, device identifiers, digital fingerprints) enabling access to information stored on the user's terminal or the storage of such information are treated as cookies.
2.2. Cookies may be placed by NOOBA itself (internal or "first party" cookies) or by third-party service providers acting on NOOBA's behalf (third-party or "third party" cookies). Cookies may have a lifespan limited to the browsing session (session cookies) or may remain stored on the terminal for a determined period (persistent cookies).
3. Categories of cookies used
3.1. Strictly necessary cookies
These cookies are indispensable for the operation of the Site and the provision of the service expressly requested by the user. They notably enable session identification, storage of the user's cookie choice and browsing security. In accordance with Article 129 of the Act of 13 June 2005, these cookies are placed without requiring the user's prior consent.
3.2. Functional and preference cookies
These cookies allow the Site to remember the choices made by the user (language, display settings, preferences) in order to improve the user's experience. They are placed only with the user's prior consent when they are not strictly necessary.
3.3. Audience measurement and statistics cookies
These cookies allow NOOBA to understand how the Site is used, compile traffic statistics and improve its content. They are placed only with the user's prior consent.
3.4. Personalization and prospecting cookies
These cookies make it possible to adapt the Site's content to the user's presumed interests and, where appropriate, offer recommendations or personalized communications. They are placed only with the user's prior consent.

4.1. The table below presents the cookies actually placed on the Site, their issuer, purpose, category and retention period. This table is updated whenever the Site is technically modified.

5. Consent banner and collection of the user's choice
5.1. On the first visit to the Site, a cookie consent banner is presented to the user. This banner complies with the requirements of the GDPR, the Act of 13 June 2005 and the guidelines of the Data Protection Authority and the European Data Protection Board, as well as the lessons drawn from the judgment of the Court of Justice of the European Union in Planet49 (C-673/17).
5.2. At the first level, the banner presents an equivalent and unbiased choice between the options "Accept all", "Reject all" and "Customize". No box is pre-ticked. Merely continuing to browse, scrolling the page or closing the banner does not constitute consent. Refusal is as easy to express as acceptance, and no disadvantage is imposed on the user who refuses cookies that are not strictly necessary.
5.3. The "Customize" option allows the user to express a granular choice by cookie category (functional, statistics, personalization and prospecting). Until the user has made a choice or in the event of refusal, only strictly necessary cookies are placed.
5.4. The user's choice is retained for a maximum period of six months, after which the banner is displayed again. The user may at any time modify their choice or withdraw consent via the cookie-management module that is permanently accessible from the Site (in particular through the "Manage my cookies" link in the footer).
6. Management of cookies through the browser
6.1. Independently of the Site's cookie-management module, the user may configure their browser to accept or refuse all or part of the cookies, to be warned before they are placed, or to delete them after each visit. Management methods differ depending on the browser used.
6.2. 6.3. Refusing or deleting certain cookies, in particular strictly necessary cookies, may impair the operation of the Site or some of its functionalities.
7. Cookies and personal data
7.1. Certain cookies may, by themselves or in combination with other information, allow the direct or indirect identification of a user, in particular by means of the IP address and technical identifiers associated with the device.
7.2. NOOBA processes these data in accordance with the privacy policy accessible on the Site, to which reference is made for information relating to recipients, retention periods, potential transfers and the rights of data subjects.
8. Rights of data subjects
8.1. In accordance with Articles 15 to 22 GDPR, Article 7.3 GDPR and the corresponding provisions of the Act of 30 July 2018, the user has, with respect to personal data processed through cookies, rights of access, rectification, erasure, restriction, portability and objection, as well as the right to withdraw consent at any time, without such withdrawal affecting the lawfulness of processing carried out previously.

9. Amendments to the Cookie Policy
9.1. This Cookie Policy may be amended in order to reflect changes in the cookies placed on the Site, the tools used and the applicable legal framework. The date of the latest update appears at the top of the document. Substantial amendments are brought to users' attention by any appropriate means, in particular by renewed display of the consent banner when the cookies placed evolve.
